In brief

The new Highway Code for motorcycles is not yet in force. Today, the 1992 Code and Law 177/2024 apply. On October 14, 2026, the deadline for the delegation to the Government expires (Law 171/2026), and the draft of the new text is expected to go before the Council of Ministers: from there, opinions and parliamentary proceedings begin, with completion estimated between February and March 2027.

For motorcyclists, the MIT draft proposes using the emergency lane in traffic jams, gloves and back protectors on motorways, parking with half the fine, and progressive penalties. These are proposals, not rules. Here you will find what is already law, what is only a hypothesis, and how to prepare your motorcycle without waiting.

The 1992 Code, updated by Law 177/2024, is still in force today

Before discussing new rules, it is worth establishing the starting point: everyday driving, whether by motorcycle or car, follows the text currently in force.

The Highway Code is Legislative Decree No. 285 of April 30, 1992, amended several times. The latest comprehensive amendment is Law No. 177 of November 25, 2024, which entered into force on December 14, 2024. It is the same law that, in Article 35, delegated the Government to reorganize the entire subject, including by drafting a new code. Everything you read about the "new Code" stems from this.

Two things that are already true today

  • Motorcycles of at least 120 cc may travel on motorways and main extra-urban roads if the rider is an adult: this change has been in force since December 14, 2024, according to the specialist press (always check the text in the Official Gazette).
  • Motorcyclists have been included among vulnerable road users, alongside pedestrians and cyclists, and during practice sessions with a learner's permit for AM, A1, A2, and A licenses, passengers may not be carried.

October 14 ends the delegation; it does not open the new Code

The date circulating in newspapers is real, but it is often described as a milestone. It is an intermediate step.

Law No. 171 of September 23, 2026, published in Official Gazette No. 228 of October 1 and effective from October 2, extended the delegation: the deadline has been extended from 12 to 22 months from December 14, 2024, therefore until October 14, 2026. It also extends the time allowed for parliamentary opinions (from 60 to 90 days) and the final extension (from 120 to 150 days). The text of the law adds that the overhaul may take place "also by drafting a new code".

  1. MIT consultation (31 July – 13 September 2026). Associations and sector organisations were able to submit proposals on the draft comprehensive rewrite.
  2. Law 171/2026 (approved by the Chamber of Deputies on 16 September). Extends the delegation to 14 October 2026.
  3. Council of Ministers (preliminary review scheduled for 14 October). The Government approves the draft legislative decree.
  4. Opinions. The Council of State and the Unified Conference have 30 days; the parliamentary committees have 90.
  5. Legislative decree and Official Gazette. The rules become applicable only after publication, together with any implementing regulations.
Timeline. Sources close to the MIT indicate that the process will be completed between February and March 2027; ItaliaOggi notes that, with the 150-day extension, the final deadline may be 13 March 2027. These are estimates, not certain dates.

The measures affecting motorcycles, one by one

This table separates what is already in force from what is merely under consideration. If a measure appears in only one source, we say so.

Measure Status What the draft says Source
Emergency lane Proposal Use permitted for two-wheelers in the event of queues, slowdowns or accidents, at low speed, while allowing emergency services to pass alVolante, Quotidiano Nazionale, Moto.it
Gloves and back protectors Proposal, not confirmed in the MIT document of July Mandatory on motorways for motorcyclists and passengers, with requirements to be defined Quotidiano Nazionale (MIT statements), HDmotori
Overtaking on the right Proposal Lane filtering on three-lane motorways; application to motorcycles not clarified alVolante, Moto.it
Parking where prohibited Proposal Fine halved for motorcycles compared with cars Moto.it, inSella
Speeding fines Proposal Progressive: €10 per km/h over 130 on motorways; €5 per km/h on roads with limits of 50 or 30 km/h Moto.it, inSella
Insurance Proposal Lack of coverage from €866 to €1,000, rule extended to mopeds Quotidiano Nazionale (MIT)
Motorcyclist safety barriers Proposal Requirement on high-risk sections alVolante
Driving licence and documents Proposal AM, A1, A2 and A licence validity unchanged; no obligation to carry a driving licence and registration document thanks to the databases MIT (July 2026 presentation), Quotidiano Nazionale
The mandatory helmet and the registration mark under consideration concern pedal cycles with propulsion (for example, delivery riders’ vehicles), not motorcycles in general. The driving licence at age 17 concerns category B.

Gloves and back protectors on motorways: what is known and what is not

It is the measure that has sparked the most debate among motorcyclists, and it is also the one with the most points needing clarification.

Quotidiano Nazionale reports, citing the MIT, that there would be a requirement to wear gloves and back protection, with characteristics established by a subsequent measure, linked to a reduction in penalties on multi-lane non-urban roads. HDmotori refers to motorways and equivalent infrastructure and to "certified" gloves, without citing an EN standard, and also reports an incentive measure: a properly protected motorcyclist who commits an offence would receive a 50% discount on the penalty. The MIT's official July 2026 presentation, however, contains nothing about clothing.

What is reasonably solid
  • The measure appears in multiple publications citing statements from the Ministry.
  • It would concern motorways, not every road.
  • The technical requirements have not yet been written.
What is not known
  • Whether the requirement would also apply to passengers.
  • What certification would be required.
  • If it really makes it into the final text.
An honest note. Endurrad does not sell gloves, back protectors, or helmets: our catalogue consists of motorcycle accessories. If the measure is adopted, we recommend choosing protective gear with certification declared by the manufacturer and checking the requirements in the implementing measure.

The emergency lane and overtaking on the right would change the way people ride

The issue here is not bureaucratic: it is about safety, and anyone travelling on a motorway with a loaded motorcycle feels it immediately.

The emergency lane for two-wheelers in traffic jams is the most concrete proposal. The sources describe the condition in different ways: alVolante writes of accidents or serious slowdowns in the text and traffic jams in the summary table. Therefore, until the final text is available, it is not advisable to rely on summaries. Today, vehicles may not travel in the emergency lane.

On overtaking on the right, the draft refers to parallel-lane traffic on three-lane motorways. Nico Cereghini, writing for Moto.it, expressed doubts about its effectiveness in Italy, where the rule to keep right is often not observed. On a motorcycle, the practical issue is lateral distance: a rider travelling with a load takes up more space than it seems. The draft also provides for barriers with motorcycle-saving devices on the most dangerous sections, a measure that speaks for itself.

On the motorway at night, visibility makes all the difference: the right approved light, with no glare.

What to do now: approved lights, properly secured load, documents on board

There is no need to wait for the new Highway Code. Some checks apply under today's rules and will apply under tomorrow's.

  • Approved auxiliary lights. An off-road spotlight is not road-legal. Look for the approval mark stamped on the housing and the certificate. Our in-depth guide to approved auxiliary lights explains how to read an ECE certificate.
  • Load secured and kept low. Load placement is regulated by Article 164 of the Code. No protrusions, lights and license plate always visible: the guide on how to secure a motorcycle saddlebag starts here.
  • Documents with you. The proposal to no longer carry your driver's license and registration document is not in force: keep them on board.
  • Checks before a long trip. Tires, brakes, lights: how to prepare your motorcycle for a long trip.

As for travel, for the cold weather ahead there's the Endurrad Adventure neck warmer, windproof and made of recycled polyester, for 9 euros. It has nothing to do with the Code, but it is appreciated on the motorway in autumn.

Frequently asked questions about the new Highway Code and motorcycles

Is the new Highway Code already in force?
No. For those riding today, the 1992 Code applies, as updated by Law 177/2024 (in force since December 14, 2024). The new text is a draft by the MIT: it must go before the Council of Ministers, receive opinions from the Council of State, the Unified Conference and Parliament, and then be adopted through a legislative decree. Reports indicate a target between February and March 2027.
What happens on October 14, 2026?
It is the deadline by which the Government must exercise its delegated authority to reorganize the Code, established by Law 171/2026. In practice, it is the date scheduled for the preliminary review of the draft by the Council of Ministers. It is not the date the rules enter into force: after the Council of Ministers, opinions and parliamentary steps are required.
Are the rules for motorcyclists changing on October 14?
No, not the very next day. October 14 marks a step in the process, not the application of the new rules. Until the legislative decree is adopted and published in the Official Gazette, the current rules remain in force.
Will gloves and back protectors become mandatory on motorways?
This is a measure reported as included in the draft for motorways, but it is not in force and is not confirmed in the Ministry of Infrastructure and Transport's official July 2026 presentation. The characteristics of the devices would be established by a subsequent measure. Today, the only item of protective clothing required by the Code is a helmet.
Will motorcycles be allowed to use the emergency lane?
The draft proposes that two-wheeled vehicle riders may use it in the event of queues, slowdowns or accidents, at low speed and while leaving the passage clear for emergency vehicles. The sources describe the condition differently - traffic jams, accidents or severe slowdowns - so the final wording remains to be seen. Today, driving in the emergency lane is not permitted.
Does overtaking on the right on motorways also apply to motorcycles?
The proposal concerns travelling in parallel lanes on three-lane motorways. The sources consulted describe it for passenger cars and do not clarify whether it applies to motorcycles: this is one of the technical details still open.
Will the licence rules for riding a motorcycle change?
Based on the information available, no. The proposed licence at age 17 concerns category B. For AM, A1, A2 and A, the validity rules remain unchanged, according to the Ministry of Infrastructure and Transport. It remains to be clarified what a category B licence at age 17 would mean for two-wheeled vehicles that a category B licence already allows the holder to drive.
Will helmets also be mandatory for people using vehicles other than motorcycles?
For motorcycles, helmets are already mandatory. The proposed change under consideration concerns so-called propelled cycles, such as the vehicles used by delivery riders, for which helmets, an identification plate and insurance are being considered, as well as children under 14 riding bicycles.
How much will it cost not to have insurance?
According to statements by the Ministry of Infrastructure and Transport reported by Quotidiano Nazionale, the penalty for not having insurance coverage would increase from 866 to 1,000 euros, with the rule also extended to mopeds. This is a proposal in the draft, not a rule currently in force.
Will speeding fines be proportional?
The proposal under discussion is a progressive penalty: 10 euros for every km/h over the limit on roads with a 130 km/h limit, and 5 euros for every km/h on roads with 50 or 30 km/h limits. The rewrite reduces the main penalty bands from 82 to around 21. These figures come from the draft under consultation.
Do I still have to carry my driving licence and registration document?
Today, yes. The Ministry of Infrastructure and Transport's July 2026 presentation indicates that in the future it may no longer be mandatory to carry a driving licence and vehicle registration document, because the information would be stored in digital databases. Until the rule comes into force, keep them with you.
Are auxiliary lights on motorcycles legal?
They are if the device is type-approved for road use and installed correctly. A spotlight sold for off-road use only is not. Approval can be identified by the mark stamped on the housing and by the certificate: the guide to type-approved spotlights explains how to read it.
What changes for luggage and bags when travelling?
Nothing, based on the information currently available. Luggage arrangement remains governed by Article 164 of the Code. The practical advice remains unchanged: keep the load low, secure it properly, with no protrusions and without covering the lights or license plate.
How can I keep up to date with the new Road Traffic Code?
The primary sources are the MIT website, the Official Gazette, and parliamentary proceedings on camera.it and senato.it. We update this guide on Endurrad when the status of the process changes; the date of the latest update is at the top of the article.
